Helping Families Resolve Conflict Without Going to Court
Navigating family disputes in Australia requires more than legal knowledge — it takes empathy, structure and clear communication. At My Divorce Lawyers, we support individuals and families in Sydney through practical, private and legally sound alternatives to litigation. Whether you’re dealing with parenting disagreements, financial division or post-separation tension, we help you move forward — fairly, calmly and with confidence.
Key Points:
Mediation is a voluntary, confidential process led by a neutral professional.
Before many parenting applications, FDR is usually required, unless an exemption applies before applying for parenting orders.
Agreements can be formalised into Consent Orders or Binding Financial Agreements.
Mediation may reduce time and cost than going to court.
Parties maintain control over the outcome, unlike court proceedings.
Legal advice is strongly recommended before and after mediation.
Mediation may not be suitable where there is family violence, urgency or major power imbalance.
What is Mediation?
Mediation is a facilitated negotiation process where both parties, with the assistance of a neutral professional, attempt to reach agreement on their own terms. It is commonly used in family law to resolve:
Parenting arrangements and custody
Property and financial settlements
Ongoing communication difficulties
Mediation can provide space to discuss options and future communication. Costs, timing, suitability and outcomes vary; an agreement is not guaranteed.
Confidentiality and use of information in court are subject to legal exceptions. Accredited FDR practitioners have specific obligations, including protections for children and safety. Ask the practitioner about the rules before sharing sensitive information.

When is Mediation Required?
Before starting many parenting proceedings, you usually need a current section 60I certificate from an accredited Family Dispute Resolution practitioner, or an applicable exemption. The Court determines exemption requests; a lawyer can advise on the evidence and procedure relevant to your circumstances.
Exceptions can include urgency, family violence or child abuse risks, and inability to participate effectively. Consent-order applications and applications for financial or property orders alone have different requirements. Do not delay seeking advice about immediate safety or urgent court orders.

Parenting Disputes and Family Mediation
Property and Financial Mediation
Financial separation after divorce or relationship breakdown doesn’t always require court. Mediation can help couples agree on:
Division of assets and liabilities
We can advise on proposed terms and the steps required to formalise an agreement. Whether an agreement is enforceable depends on the legal requirements and circumstances.
Is Mediation Legally Binding?
The mediation process itself is not binding — but any agreement reached can be formalised as:
Consent Orders, which are approved and enforceable by the Family Court
Binding Financial Agreements, for property and spousal support matters
We’ll help you decide which path is best and prepare the documentation accordingly.

FAQs
Frequently Asked Questions
Answers to common questions about the divorce process, legal rights, and next steps.
A current section 60I certificate or applicable exemption is generally needed before starting parenting proceedings. Exemptions and filing requirements depend on the application and circumstances; seek advice if there are safety concerns or urgency.
Mediation may reduce costs if it helps resolve a dispute, but there is no guaranteed saving or number of sessions. Ask the provider about fees and discuss legal costs before deciding how to proceed.
Yes — and it’s recommended. We provide legal advice throughout the process to protect your rights and make sure the agreement is fair.
Accredited FDR has confidentiality and evidence protections, with legal exceptions including safety and child-protection obligations. These protections do not automatically cover every conversation with an intake worker or every kind of mediation. Ask the practitioner which rules apply.
